notice-and-takedown system has actually enabled much greater authorized
availability of music, by reducing transaction costs."

An excellent point about the transaction costs of authorisation.  This
is why Creative Commons, Magnatune's licencing, transcopyright and other
forms of pre-authorisation all provide significant increased value.
